Terms & Conditions of Sale for Online Purchases

 

Welcome to Connecticut Stone Supplies, Inc.  We ask that you abide by the terms and conditions that follow, along with any other terms and conditions that may appear on the Site from time-to-time (collectively, the “Conditions”).  Your use of the Site constitutes your agreement with the Conditions that follow and we reserve the right to revise these Conditions at any time.  When we make changes, we will post them here.  You agree to check this section periodically to be aware of any changes and your continued use of the Site shall be considered your agreement to any modified Conditions.  If you do not agree to these Conditions, please do not use the Site.

 

  1. PALLET DEPOSITS

After your online order is placed, Connecticut Stone will calculate the number of pallets required for your order (if applicable). Pallets may be required on items like cobblestonesconcrete paving stones and concrete wall systems. Pallet deposits are billable at $20 + tax per pallet and they are refundable when returned within 6 months of purchase. If the order requires a pallet and there is a balance due, a Connecticut Stone Team Member will contact you for payment.

 

  1. DELIVERY

 

Delivery is available and can be added to your order.  You may purchase your product online and call us to request delivery.  Depending on the product, we may first require you to see the product in person or approve the product via current lot photos.  Because most of our products are natural stone, there is variation from lot to lot.  Once the material has been viewed and approved, we will be happy to arrange delivery for you.  

  1. RETURNS 

Approved returns of Connecticut Stone products are at the discretion of Connecticut Stone and when approved, must be made within 30 days of purchase. 

All return requests must be made within 5 days of shipment or pick up date. All products authorized for  return must be in the original, unopened packaging, in full case quantities and in good condition, suitable  for resale. We will not accept material if the product has been culled through, chipped, damaged, installed,  marred or marked in any way.  

 

Note that bagged cement products including polymeric sand, Portland cement, mortars, thin set, Quikrete and other similar products are not returnable. 

 

Approved returns are subject to a 20% restocking fee. Additionally, all costs associated with returning the product to Connecticut Stone and/or the original manufacturer will be the responsibility of the Buyer. 

 

  1. DISCREPANCIES & DEFECTS 

 

Connecticut Stone is not responsible for confirming quantities and determining waste factors.  Any quote or sales order provided by Connecticut Stone is an estimate only.  It is the buyer’s responsibility to confirm quantities, waste factors and other details prior to ordering.

Connecticut Stone may cure any discrepancy consisting of a shortage in quantity of any product by delivering a conforming quantity of product to the Buyer, by one of our delivery trucks or via a common carrier or other means of transport selected and provided by Connecticut Stone, as soon as reasonably practicable after the  Buyer notifies Connecticut Stone in writing of the shortage, in which case the Buyer shall have no further recourse to Connecticut Stone. 

In the event of a defect within any product distributed to the Buyer by Connecticut Stone, the Buyer agrees to notify Connecticut Stone in writing immediately upon becoming aware of such defect. If a defect in manufacturing or coloring is identified in advance of installation, the Customer agrees NOT to install any defective product without the written agreement of Connecticut Stone. INSTALLATION  EQUALS ACCEPTANCE.  

Connecticut Stone reserves the right to inspect any and all defects prior to any repair, remediation or settlement of any defect. In the event that Connecticut Stone is required to participate in the repair, remediation or settlement of any defect, Connecticut Stone must be included in all discussions and decisions related to the repair, remediation and/or settlement. 

In the event that the Buyer fails to notify Connecticut Stone on a timely basis, or fails to allow Connecticut  Stone the right of inspection, discussion or decision making in advance of repair, remediation or settlement of any defect, the Buyer agrees to release Connecticut Stone from any liability for the discrepancy or defect. 

Buyer misuse including negligence, physical or chemical treatment, is not covered by this warranty. 

Improper installation, improper use of a material for a particular application (i.e. using wall tile in a  floor application), installation defects or errors are not covered by this warranty. 

Warranty claims must be submitted in writing within 10 days after the delivery or pick up date. 

Buyer shall notify Connecticut Stone in writing on or before the close of business on the 10th day of any discrepancy or non-compliance issue. Buyer will permit Connecticut Stone to inspect any alleged discrepancy at the place where the products are located during normal business hours. 

 

  1. LIMITED WARRANTY 

Connecticut Stone warrants to the Buyer that the products will be the quantity and type of product provided in this order. When placing an order for natural stone, concrete paving stones, concrete retaining wall systems, or fire pits, it is important to understand the variation in the product. These products may vary in shade, size, thickness, color, and texture. You will have an opportunity to view the product in person when you or your authorized representative pick up. Please speak with your sales representative about the variation in the product(s) you selected and request a current lot photograph of the material prior to confirming your purchase.  

Connecticut Stone disclaims all other warranties, express and implied, related to the products, including any implied warranties of merchantability and fitness for a particular purpose.  

Connecticut Stone makes no warranty related to the composition, grade, weight, quantity, breaking strength,  yield, stain resistance, color, finish, fire retardancy, performance, design capabilities or capacities, other mechanical, physical or chemical properties, absence of minor usual or ordinary defects or variation in thickness or finish of the products or percentage, size and shape of markings. 

Connecticut Stone’s limit of liability for any claim is the dollar amount of actual material supplied.  

Natural stone products are products of nature mined and cut from natural formation which may inherently contain high levels of variation. Because these products are mined and cut from natural formations, Connecticut Stone does not warrant natural stone products for shade, size, thickness, warping, cleft variations, surface finish variations or other natural defects on stone products. In addition, there are color variations with all concrete paving stones, steps and wall systems.

  1. CANCELLATION FEES 

If the Buyer wishes to cancel an order after it has been placed, a cancellation fee may apply. The fee,  determined by Connecticut Stone, will not be less than 15%.  

 

  1. JURISDICTION 

You are entering into a legal contract with Connecticut Stone. This agreement shall be governed by and construed in accordance with the laws of the State of Connecticut.
